K1 Fiancee
Your fiancee comes to the US and you have 90 days to marry.
K3/CR1 Spousal
You marry in your fiancee’ country before you file the petition.
How long does it take? Depending on the country, a Fiancee visa takes 5-10 months from the time of filing with USCIS. Depending on the country, a Spousal visa takes 10-18 months from the time of filing with USCIS.
Can my Fiancee’ children come to the US? All children under 21 at the time of the Embassy interview are eligible for a K2 visa with the parent’ approved K1 visa. No paperwork or filing fees at USCIS for the K2. All children under 18 at the time of the marriage are eligible for a CR2 or K4 visa until they reach the age of 21. You must file a CR2 petition with USCIS with a filing fee for each child immigrating.
What are the pros and cons? The Fiancee visa is faster than the Spousal visa.
If she gets to the USA and it is not working out (incompatibility, homesickness, etc.) she can return to her country before you get married and there is no more paperwork to deal with.
Eligible children can come without filing a separate petition.
After you are married, your spouse and all children who immigrated must file Adjustment of Status petitions to be granted resident status.
A spousal visa is given NO preference over a Fiancee visa.
If the visa is denied, you will have a spouse in a foreign country that you cannot bring home.
If her visa is denied or she comes to the US and it is not working out, you will need to obtain a divorce or annulment in a foreign country.
This is a complicated 2 petition filing, the required CR1 petition and the optional K3 petition.
The Spousal visa takes longer than the Fiancee visa.
Separate petitions and filing fees are required for each child immigrating.
If your spouse comes into the US using the K3 visa, It is usually faster than the CR1 but the Adjustment of Status filing is required to receive resident status (green card).More paper work and USCIS filing fee.
If your spouse comes into the US using the CR1, usually slower than the K3, she/he will receive resident status (green card) shortly after entering. No more paperwork or filing fees.
